Description
Order GRANTING MOTION FOR RECONSIDERATION On May 14, 1993, defendant-appellant Michael Akio Nishi (Appellant) filed a motion for reconsideration, claiming that the opinion filed on May 4, 1993 ""overlooked the fact that the State failed to prove that the person named in the abstract was the same person as Defendant-Appellant NISHI."" The court ""overlooked"" the matter raised in the motion for reconsideration because Point C in the ""Statement of Points of Error"" in Appellant's Opening Brief merely concluded that ""proof of the prior conviction may only be in the nature of a certified judgment[,]"" and that proof by a certified copy of a traffic abstract is inadequate. However, upon reconsideration, the court believes that the general heading of Point C and the Discussion in the Argument section of the Opening Brief sufficiently raised an issue which the court should have discussed and ruled upon in its May 4, 1993 opinion.
